What is a Receiver?

A Receiver is a temporarily-appointed, disinterested 3rd party “fiduciary” who helps a business or person preserve assets and property while litigation is ongoing. A Receiver is the agent of the court and is appointed by the judge (usually at the request of one of the parties.) The Receiver’s responsibility is to ensure that property is protected or the business operates without interference or influence from the lawsuit parties. The Receiver reports directly to the judge handling the case and enforces the judge’s orders in the case. Please read our “Introduction to the Receivership Remedy“ as published in the San Bernardino County Bar Association Newsletter for more information.
