California Health and Safety Code Receiverships

What is a Receivership in California?

A receivership is a legal remedy used when a court appoints a neutral third party—called a Receiver—to take temporary control of property or assets during litigation.

Under California law, a Receiver may be appointed in civil cases involving business disputes, family law, judgment enforcement, probate, and Health and Safety Code violations.

What is a Health and Safety Code Receivership?

A California Health and Safety Code receivership is a specific type of receivership governed by California Health and Safety Code §§ 17980.6 and §§ 17980.7 and is typically initiated by a city or county when a property owner is unable or unwilling to correct code violations.

California Health and Safety Code receiverships often involve building done without permitting, abandoned properties, fire-damaged properties, and other nuisance-type properties including buildings with hoarding storage problems.

What role does a Receiver play in the process?

In a Health and Safety Receivership, the Receiver acts as a neutral agent of the court, appointed to temporarily assume possession and control of real property that poses a danger to public health and safety.

The Receiver’s responsibilities include securing the property, coordinating with local code enforcement officials, and hiring licensed contractors to bring the property into compliance with health and safety standards. The Receiver may also obtain insurance, apply for court-approved financing to fund repairs, collect rental income, and—when necessary—oversee the relocation of tenants.

Throughout the process, the Receiver files detailed reports with the court and may request authority to reimburse expenses or sell the property if rehabilitation is impractical. All actions must comply with court orders and are subject to judicial oversight to ensure transparency and neutrality. (See Health and Safety Code §§ 17980.7(c)–(d); City of Santa Monica v. Gonzalez (2008) 43 Cal.4th 905.)
