Los Angeles County Partition Referee: Resolving Co-Ownership Property Disputes in LA
Disputes between co-owners of real estate in Los Angeles, whether they’re siblings who inherited a home in Highland Park, divorced couples splitting a duplex in Venice, or business partners dividing investment property near Koreatown, can quickly turn into costly, stressful legal standoffs.
When co-owners cannot agree on how to manage, sell, or divide jointly-owned property, California law provides a legal solution: a partition action.
What Is a Partition Action in California?
A partition action is a court-supervised process that allows any co-owner of real estate to legally force the division or sale of property. This right is protected under California Code of Civil Procedure § 872.210. Unless specifically waived, any co-owner, whether living in Los Feliz, Inglewood, or Silver Lake, can initiate this legal process.
In Los Angeles, these cases are typically filed at the Stanley Mosk Courthouse, located at 111 N Hill Street, Los Angeles, CA 90012, near Grand Park and City Hall.

Types of Partition Actions
California law allows for three primary types of partition:
- Partition in Kind
The property is physically divided between the co-owners. This type of division is more common in undeveloped parcels, such as land in areas like Topanga Canyon or Sunland.
(CCP § 872.810)
- Partition by Sale
The property is sold on the open market and the proceeds are equitably divided. This is the most common route in urban Los Angeles neighborhoods like Echo Park, West Adams, or Mar Vista.
(CCP § 872.820)
- Partition by Appraisal
One or more owners may buy out the others based on appraised value, often under the newer Partition of Real Property Act (CCP §§ 874.310–874.323). This option provides a less disruptive alternative to public sale and is increasingly used in co-owned residential properties.
The Two Phases of a Partition Action
-
Ownership & Sale Decision
The court determines ownership percentages and decides whether the property should be sold or divided. At this stage, legal documents, deeds, and financial contributions are reviewed, often with the assistance of a Los Angeles Partition Referee.
-
Accounting & Distribution of Proceeds
If the court orders a sale, it will ensure the proceeds are distributed fairly. This includes compensation for:
- Unequal contributions to the mortgage, taxes, or insurance
- Costs for repairs and improvements
- Rental income or exclusive use of the property by one co-owner
These adjustments are governed by CCP § 873.850 and supported by case law, such as Milian v. De Leon (1986) 181 Cal.App.3d 1185.
What Does a Los Angeles Partition Referee Do?
A Los Angeles Partition Referee is a neutral third party appointed by the court to manage the division or sale of the property. The referee is paid from the sale proceeds, not by any individual co-owner.
In a Partition by Sale, the referee’s role includes:
- Hiring a licensed Los Angeles real estate broker
- Setting a fair listing price (e.g., for a condo in Downtown LA or a home in Sherman Oaks)
- Managing offers, counteroffers, and negotiations
- Signing documents on behalf of any non-cooperative or absentee co-owners
In a Partition in Kind:
The referee may oversee physical division of larger parcels, such as undeveloped land near the Angeles National Forest or properties in the San Fernando Valley.
Additional Responsibilities:
- Reviewing claims for reimbursement
- Investigating liens filed with the Los Angeles County Recorder’s Office
- Making court recommendations to ensure fair resolution
By acting as a neutral party, a Partition Referee ensures the process moves forward, even when co-owners refuse to cooperate or are unreachable.
